Held:-

An appellant who wants to withdraw an appeal /notice of appeal, he should follow the procedure laid down under Rule 102 of the Court of Appeal Rules, 2009.  If he waits until the matter comes for hearing to file the notice of withdrawal, he should be liable to costs.
