• Notice of appeal – Notice of appeal indicates that the appellant was convicted of rape while the record of appeal shows that he was convicted of grave sexual abuse – Effect – Rule 68 (2) of the Court of Appeal Rules, 2009.

Held:-

A notice of appeal in criminal case should comply with Rule 68 (2) of the Court of Appeal Rules in that it should indicate the correct offence the appellant was convicted of.  Failure to do so renders the notice of appeal and the appeal incompetent.
