• Extension of time – Application for extension of time to file notice of Appeal – whether a Resident Magistrate with extended jurisdiction has jurisdiction to hear the application.

Held:-

It is only appeals originating from District Courts which can be transferred to a resident magistrate with extended jurisdiction.  A resident magistrate with extended jurisdiction has no jurisdiction to hear applications for extension of time within which to file notice of appeal.
