Held:-

(i)  As a general rule, where a party has the right of appeal, he cannot be permitted to resort to revision.

(ii) Under section 4(2) of the Appellate Jurisdiction Act, 1979 as amended by Act No. 17 of 1993, the Court of Appeal when exercising its appellate jurisdiction is empowered to exercise the power of revision.
